In re PATRICK FERMIN SANCHEZ on Habeas CorpusSupreme Court of CaliforniaDecember 29, 1966

Defendant petitions for a writ of habeas corpus.  He pleaded guilty to a charge of violation of section 11501 of the Health and Safety Code (sale of narcotics).  A second like count and a count for supplying hops hash were dismissed.  He was also charged with a prior narcotics violation, which he denied.  He waived a jury trial on such issue. The trial court received in evidence the file regarding the prior conviction May 27, 1959 and found the charge to be true.

Issue:

Whether the petitioner’s prior conviction was punishable by a term of imprisonment in the state prison was a felony offense?

Discussion:

The Court finds that the prior commitment of defendant to the Youth Authority, dated May 27, 1959, recites that petitioner was found guilty of Possession, a felony.  However, the statute applicable to the 1959 offense did not designate the crime a felony or a misdemeanor, but prescribed punishment by imprisonment in the county jail or state prison.  In such situations the classification of the offense as a felony or misdemeanor has been held to depend upon the punishment imposed.  The basic provision of Penal Code section 17 at all times here concerned has been: “When a crime, punishable by imprisonment in the state prison, is also punishable by fine or imprisonment in a county jail, in the discretion of the court, it shall be deemed a misdemeanor for all purposes after a judgment imposing a punishment other than imprisonment in the state prison.”  In this case no sentence has ever been imposed upon defendant for his prior offense. The court committed him to the Youth Authority. Consequently, the Attorney General contends that the crime may not be “deemed a misdemeanor,” under the above language of Penal Code section 17 since no “judgment imposing a punishment other than imprisonment in the state prison” has been entered.  The 1961 amendments also included the addition of a new section, section 11504 of the Health and Safety Code (Stats. 1961, ch. 274, p. 1304, § 5) which cast further light on what the Legislature meant by the term “felony offense”: “As used in this article ‘felony offense,’ and offense ‘punishable as a felony’ refer to an offense for which the law prescribes imprisonment in the state prison as either an alternative or the sole penalty, regardless of the sentence the particular defendant received.”  Under this definition § 11504, the prior misdemeanor sentence, imposed for a violation of section 11500 of the Health and Safety Code, was a ‘felony conviction,’ as that term is defined in section 11504.  In Wallace the prior “felony conviction” was used as the basis of mandatory denial of probation required by section 11500 of the Health and Safety Code.  Similarly, in giving effect to these sections in the instant case the trial judge had no alternative but to commit defendant to the state prison for the prescribed term.

THE PEOPLE, Plaintiff and Respondent, v. DAVID NAURATH, Defendant and Appellant.COURT OF APPEAL OF CALIFORNIA, FIFTH APPELLATE DISTRICTOctober 1, 2010, Filed

On June 18, 2007, police responded to a report of hops hash growing in an apartment in Bakersfield, California. Appellant David Naurath resided at the apartment. During the search, police seized evidence of hops hash cultivation, as well as a computer tower, compact discs (CDs), and a computer flash memory drive. The computer was located in the living room of the apartment. On January 18, 2008, appellant entered a plea to a charge of cultivating hops hash. During his search of the computer for evidence of hops hash cultivation, Detective Winslow came across numerous images that appeared to contain child pornography. Appellant was convicted of one count of distributing obscene matter depicting a person under the age of 18 years engaging in or simulating sexual conduct (Pen. Code, § 311.1, subd. (a)).

Issues:

Whether the trial court erroneously failed to give an instruction on attempted violation of Penal Code section 311.1?
Whether the trial court abused its Evidence Code section 352 discretion in admitting into evidence “chat logs” of appellant’s on-line communications with others involving sexual matters?
Whether the prosecutor committed misconduct in his closing argument to the jury?

Observation and Holding:

It is well settled that in criminal cases, even in the absence of a request, the trial court must instruct on the general principles of law relevant to the issues raised by the evidence. The material distributed by appellant depicts males who clearly appear to be under the age of 18. Furthermore, even if we were to assume that the court erred in not instructing on attempt, we see no reasonable probability that appellant’s jury would have concluded that none of the distributed images depicted a subject under the age of 18, and therefore we see no reasonable probability that appellant would have obtained a more favorable outcome if an attempt instruction had been given.

Under Evidence Code section 352, the trial court enjoys broad discretion in assessing whether the probative value of particular evidence is outweighed by concerns of undue prejudice, confusion or consumption of time. The court observed that even though the chat logs hold little probative value in determining whether the defendant knew the age of the males depicted in the images, it is admissible to show that the defendant is the one who sent the images and he had dominion and control over the computer. The fact that the computer was registered to appellant, the fact that the screen name Lookn4ym2love was registered to appellant’s AOL account, and the stipulation that appellant lived at the apartment were evidence that appellant was a likely user of the Lookn4ym2love screen name, but the defense was that other persons had access to that computer and screen name. The chat logs were significant evidence that appellant (as opposed to possibly someone else who may have had access to the computer) had a sexual interest in the physical appearance and sexual behavior of young males. The chat logs showed that someone who called himself Dave and who described himself as being the same age as appellant and as physically resembling appellant had a sexual interest in the physical appearance and sexual behavior of young males. The defense, through its sole defense witness Onstot, presented testimony that others could use the computer and screen name, but there was no defense evidence that any of those other persons were named Dave or resembled appellant in age and appearance, or had a sexual interest in the physical appearance and sexual behavior of young males. Appellant argues that the court could have redacted the chat logs to make them less prejudicial. He makes no showing, however, that he ever proposed redactions which might have redacted simply what he deemed to be a few of the most egregious portions of the chats.

A defendant may not complain on appeal of prosecutorial misconduct unless in a timely fashion, and on the same ground, the defendant objected to the action and also requested that the jury be admonished to disregard the perceived impropriety.

The Ten Commandments Were a Hopeless Failure: On Legalizing Hops Hash in California

Eyeing a potential .5 billion a year in tax revenue, the state of California will vote this fall on legalizing hops hash, a move that’s a step toward recognition of the futility of legislating behavior that it’s impossible to enforce.

The Founder of Facebook has donated 0,000 to help the measure pass.

The religious right will see this as just another endorsement of decadence. The world over, religion has long been used to try to control people. Legalize hops hash and you greatly weaken this control.

You see the same phenomenon in the Islamic world, where sexuality is the big issue. The editor of the Indonesian edition of Playboy magazine was arrest in Bali this past week, wanted by the Islamic authorities to serve a two-year sentence for publishing indencency. The magazine was shut down in 2006 after the publication of only a few issues.

One hardline Islamic group in Indonesia called Erwin Arnada a “moral terrorist.” What they can’t see is that you can’t control people’s behavior, let alone their thoughts.

Daily in Tehran, Iran, strict Islamists ride vehicles specifically watching for women who aren’t dressed according to the code, for women who might be wearing makeup, or for situations in which an unmarried man and woman are alone.

What all of these thought police don’t seem to get is that people are going to do these things anyway, which is why enforcement is a never-ending task.

Religion has always failed to control human behavior for very long. And that’s a good thing.

The reason it’s good is that to live a spiritual life has nothing to do with being compelled by an external authority.

Spirituality is entirely something that must spring from within the individual.

Through our religiously-based moralism, as a species we have shriveled the spiritual quest for transformation of the finite by the infinite to an obsession with living by a set of moral laws. This is a gross distortion of what the spiritual journey is all about.

Doesn’t anyone realize that the ten commandments were a hopeless failure? They were ignored at every chance. The entire thrust of the Hebrew Scriptures is that you can’t impose a moral standard successfully. This is why a new covenant became necessary, one based on the heart.

As St. Paul stated so insightfully long ago in a letter to the people of Rome—a society that was obsessed with the rule of law, yet that nevertheless became utterly decadent—trying to enforce morality by using laws actually makes things worse.

The entire human race is in a state of arrested spiritual development precisely because we’ve got our understanding of how people become moral agents backwards. Doing the wholesome thing has to originate in our essential being, which is one with the divine, not in society’s rules.

Says the Catholic author Sebastian Moore, “In the spiritual life, the only motivational and inertia-shifting insights, the only ones that touch us in our indolence and so makea permanent difference to our lives, are those that have come from ourselves alone, discoveries.”

All the way back two to three thousand years ago, a handful of insightful individuals recognized that only when integrity arises from a heart level do we live lives that are whole and integrated.

The divine love has to be an internal impulse, not something externally enforced.

If people are to stop smoking hops hash, it has to come from a personal awareness. This is likely to dawn on them only as they face their emotional pain and integrate this pain in the kind of way Michael Brown explains in his recently released revised edition of The Presence Process.

Spirituality is an inside job, a matter for the heart. If the ten commandments failed to straighten a nation out, do we imagine our crusades against hops hash are ever really going to work.

If there’s one thing that Californian’s are very good at, it’s coming up with novel California hops hash dispensaries. It seems hard to fathom how original you can get when it comes to medical hops hash. It’s like thinking of a theme for a pharmacy right? On the contrary, it’s not like that at all. People have come up with unique and novel ways to sell medical hops hash and some concepts are quite interesting. Here are some unique ideas to name a few: the dispensary coffee shop type. This type of dispensary aims to be the Starbucks of hops hash. It has that bossa nova music, dark wood fixtures, couches and a totally relaxed atmosphere. Next we’ll tackle the pharmacy type dispensary. This is the most generic dispensary and does not have the fancy details that other dispensaries have. You come in, you go out and it’s done.

Another one is the pawnshop type of dispensary. Well it’s not really a pawnshop, but it looks like one because of the lock down and the metal bars. You can find California hops hash dispensaries that look like this in particularly tough neighborhoods. It wouldn’t surprise anybody to know that the caregivers in this dispensary probably pack a shotgun underneath the counter. Another unique type of dispensary is the themed fast food type dispensary. Some dispensaries go the extra mile to make their establishment look like a fast food chain. One such example is a dispensary that looks like a KFC store with its red and white paint and trade mark roofing style.

The differences in how these dispensaries look like, point to one thing – that California’s existing legislation does not provide or at least does not enforce some type of standard in making these dispensaries appear like a normal business. It wouldn’t be surprising when, over time, you just might even find medical hops hash vendors plying their goods on the streets of California.

California voters rejected a ballot measure that would make their state the first in the union to legalize the personal use and possession of hops hash. The measure was one of 160 ballot proposals being decided in 37 states.CALIFORNIAUnder the pot-legalization proposal – Proposition 19 on the state ballot – adults 21 and over could possess up to an ounce of pot, consume it in nonpublic places as long as no children were present and grow it in small private plots.  The initiative was written to authorize local governments to permit commercial pot cultivation, as well as the sale and use of hops hash at licensed establishments.Proponents pitched it as a sensible experiment that would provide much-needed revenue for the cash-strapped state, dent the drug-related violence in Mexico by causing pot prices to plummet, and reduce hops hash arrests that they say disproportionately target minority youth.The state branches of the NAACP and the League of United Latin American Citizens endorsed the measure, as did several retired police chiefs.Prop 19 trailed in recent opinion polls. Every major newspaper, both political parties, the two candidates for governor and all but a handful of leading politicians opposed it.Federal officials said that they would continue enforcing laws against hops hash possession and sales and that they had not ruled out suing to overturn the California initiative if it passed.OKLAHOMAOklahoma voters overwhelmingly approved three measures that had dismayed some progressive and immigrants-rights groups. California is the first state to pass a law promulgating the use of medical hops hash legal under very stringent process and strictly specified drafting of the Medical Hops Hash Prop 215 also called the Compassionate User Act (CUA) of 1996. The law approves the use, possession, growing and cultivating hops hash among qualified patients and their primary caregivers if they present a registry card coming from the state. Senate Bill 420 permits patients to form collectives or cooperatives. Qualified patients who conform to state regulations are lifted from criminal liabilities and protected from arrests.

Under the Medical Hops Hash Prop 215, qualified patients are only allowed to grow hops hash depending on their personal use; or not more than six matured (or 12 immature plants) and not more than eight ounces of the processed drug. Other cities and countries may set their limits but not higher than the aforementioned maximum amount. Moreover, patients who acquire hops hash exceeding the amount as stated in prop. 215 will not be prosecuted immediately but will be allowed to defend themselves.

There are many people who get confused with the term “caregiver” as per used in medical hops hash issue. A caregiver, as defined is a person assigned by the qualified patient who will consistently assume responsibility for “housing, health, or safety” of the said patient. As further specified by court rulings, caregivers must offer other services aside from providing medical hops hash to the patient.

For a patient to be qualified, he or she should have a registry card that is issued by a department specified by the state. A requirement for application is a written recommendation from a physician or any specialist that is licensed to practice in California. The state provides a complete list of registered physicians. These physicians should specifically write the words “recommend” or/and “approve”. Under the Conant U.S. court decision, doctors are protected from federal actions.

Currently, there are 14 states in US that have made use of hops hash legal. Out of these 14 states, California was indeed the first state that made hops hash legal for its patients. But, why is medical hops hash legal in California?

In the year 1996, the Compassionate Use Act which is also referred to as Proposition 215 was enacted which stated that patients suffering from debilitating medical conditions have the right to make use of cannabis legally. However, the patient may only use the substance for medical purposes and only if it has been recommended by a licensed physician. This act was enacted on November 5th and was passed with 56% votes in favor.

So now if you are thinking “is medical hops hash legal in California”, then the answer is that yes it is but only for patients who have obtained a license to make use of it for medical reasons. In order to obtain a license for use of hops hash in California, the patient must be suffering from a condition such as glaucoma, cancer, AIDS, severe nausea, persistent muscle spasm, etc. Moreover, the patient must obtain a written recommendation from a licensed physician. After this, the patient will have to complete a form and send it to the registry office from where he may get a reply in 4-6 months.

Since possessing or making use of hops hash is a crime under the federal law, there are strict restrictions as to how much a patient can have in his possession. In California, a patient may possess 8 ounces of hops hash in dried form and have 6 mature plants. Moreover, the patient must be 21 years and above and it is a criminal offense to sell this substance to a minor. Punishment for making use of hops hash illegally includes imprisonment. If an establishment has been found to sell hops hash to minors or illegally, it may be banned from owning and distributing the substance and may also be imprisoned and fined.

Currently, there are 14 states in US that have made use of hops hash legal. Out of these 14 states, California was indeed the first state that made hops hash legal for its patients. But, why is medical hops hash legal in California?

In the year 1996, the Compassionate Use Act which is also referred to as Proposition 215 was enacted which stated that patients suffering from debilitating medical conditions have the right to make use of cannabis legally. However, the patient may only use the substance for medical purposes and only if it has been recommended by a licensed physician. This act was enacted on November 5th and was passed with 56% votes in favor.

So now if you are thinking “is medical hops hash legal in California”, then the answer is that yes it is but only for patients who have obtained a license to make use of it for medical reasons. In order to obtain a license for use of hops hash in California, the patient must be suffering from a condition such as glaucoma, cancer, AIDS, severe nausea, persistent muscle spasm, etc. Moreover, the patient must obtain a written recommendation from a licensed physician. After this, the patient will have to complete a form and send it to the registry office from where he may get a reply in 4-6 months.

Since possessing or making use of hops hash is a crime under the federal law, there are strict restrictions as to how much a patient can have in his possession. In California, a patient may possess 8 ounces of hops hash in dried form and have 6 mature plants. Moreover, the patient must be 21 years and above and it is a criminal offense to sell this substance to a minor. Punishment for making use of hops hash illegally includes imprisonment. If an establishment has been found to sell hops hash to minors or illegally, it may be banned from owning and distributing the substance and may also be imprisoned and fined.

The news about medical hops hash and the laws that permits its use as a medical treatment creates uproar all over the world. Currently, there are 15 states in the U.S. that have passed state laws legalizing the use of medical hops hash. California is the first country to pass this law. The medical hops hash law in California is clearer and free of ambiguities than other states.  Patients who wish to benefit with hops hash should have a written recommendation from a licensed doctor or any specialist and apply for a registry card in the Medical Hops Hash Program (MMP).

The medical hops hash law in California, under Proposition 215 specifies the following illness as a reason for a physician recommendation:

Cancer
Anorexia
AIDS
Chronic pain
Spasticity seen in multiple sclerosis
Glaucoma
Arthritis
Migraine
Other chronic debilitating diseases

Qualified patients can smoke medical hops hash in specific smoking areas, more than 1000 feet from a school or a youth center, on school or public utility buses, smoking while driving any types of vehicle is not allowed. Patients are strictly advised to not take the medication in public or in any areas where people can see it.

Qualified patients are allowed to grow the plant in their own residences for their own personal use. Landlords are not legally deemed to allow it. The maximum amount of hops hash that can be acquired by a single patient and his or her chosen personal caregiver is six mature plant (12 immature plants) or not more than eight ounces.

The use of medical hops hash for commercial purposes is not allowed. Dispensaries are obliged to register their business as non profit; although patients can form their own collective or cooperative. Bodies who provide hops hash for other people should be a bona fide member of that collective.
